Terms of Service

These Terms of Service ("Terms") govern your access to and use of Katacy, including the website at katacy.com and the Katacy web application (collectively, the "Service"), operated by Katacy ("we," "our," or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Age requirement: You must be at least 13 years old to use Katacy. By creating an account, you confirm that you are 13 years of age or older. If you are under 18, you confirm that you have permission from a parent or legal guardian to use the Service.

1. Description of the Service

Katacy is a pageant interview preparation platform that provides practice questions, an interview simulator, AI-powered answer feedback, a word bank, and related tools to help contestants prepare for pageant interview competition.

Katacy is an independent practice and preparation tool. It is not affiliated with, endorsed by, or officially connected to any pageant system, organization, or competition.

2. Account registration

To access most features of Katacy, you must create an account. You may register using an email address and password or by signing in with a Google account.

You are responsible for maintaining the security of your account credentials. You agree not to share your password or allow others to access your account. You are responsible for all activity that occurs under your account.

You agree to provide accurate information when creating your account and to keep that information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

3. Subscription plans and billing

Katacy offers the following subscription plans:

All prices are in US dollars and subject to applicable taxes. We reserve the right to change pricing at any time. Price changes will be communicated to existing subscribers at least 30 days in advance and will take effect at the next billing cycle.

Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.

Annual billing: Annual subscriptions are billed in full at the time of purchase for a twelve-month period.

Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.

4. Refund policy

All purchases are final and non-refundable. We do not offer refunds for subscription payments, including partial-period refunds for cancellations mid-cycle.

If you believe you have been charged in error, please contact us at support@katacy.com within 14 days of the charge and we will review your case.

We recommend using the free plan to evaluate Katacy before purchasing a paid subscription.

5. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to your paid features until that date. After cancellation, your account will revert to the Free plan.

Cancelling your subscription does not delete your account or your saved data. To delete your account entirely, contact us at support@katacy.com.

6. Acceptable use

You agree to use Katacy only for lawful purposes and in accordance with these Terms. You agree not to:

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Intellectual property

All content on Katacy — including the question bank, word bank, practice frameworks, suggested phrases, interface design, copy, and underlying software — is owned by or licensed to Katacy and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any Katacy content without our express written permission. Accessing Katacy for your personal practice use does not grant you any ownership or license rights to its content.

Your content: Any questions, answers, or other content you add to your account (such as custom questions) remain yours. By submitting content to Katacy, you grant us a limited license to store and display that content for the purpose of providing the Service to you.

8. AI feedback disclaimer

Katacy uses artificial intelligence to provide feedback on your practice answers. This feedback is generated for practice and educational purposes only.

AI feedback scores and suggestions are not a guarantee or prediction of your performance in any actual pageant interview. Pageant judging is subjective and depends on many factors outside the scope of this platform. We make no representation that using Katacy will result in improved placement or any particular outcome in competition.

AI feedback is provided as-is. We do not warrant that it is accurate, complete, or applicable to your specific situation or pageant system.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KATACY AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Katacy and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.

You may terminate your account at any time by contacting us at support@katacy.com. Termination does not entitle you to a refund of any fees paid.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimer, limitation of liability, and governing law sections.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription before the changes take effect.

15. Miscellaneous

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Katacy regarding the Service and supersede any prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
